Types of Injury Cases
Car Accident Injury
Victims of car accidents suffer from a wide range of injuries, such as whiplash, fractures, internal injuries and head trauma. These injuries cause pain, emotional distress, and financial burdens. Treatment may involve ongoing medical care, physical therapy, surgery, and/or chiropractic care.
Slip and Fall Injury
Slip and fall accidents can occur at any time and in various settings, such as in stores, workplaces, or public places. Hazardous conditions like wet floors or uneven surfaces are often to blame. These accidents can lead to broken bones, sprains, or back injuries and head injuries. Victims may face physical limitations and emotional trauma, requiring medical treatment such as surgery, rehabilitation, or psychological counseling.
When healthcare professionals make errors in diagnosis, treatment, or surgery, patients may suffer severe consequences and even a wrongful death. Injured victims may require corrective surgeries, ongoing medical care, and physical therapy, while also coping with the emotional distress of medical malpractice.
We must hold medical professionals responsible and accountable for their negligence, to ensure the best possible care for everyone in our community.
Injuries caused by defective products can range from burns and lacerations to more severe injuries that can affect a person’s quality of life. For instance, a faulty appliance may cause severe electrical burns, or electric shock, leading to extensive medical treatment and rehabilitation.
I am here to ensure you are compensated for your injuries, but I also want to give consumers peace of mind knowing what they buy will operate without issue. Holding manufacturers accountable for their failures is how we ensure quality of product.
Dog Bite Injury
Dog attacks can result in severe injuries, particularly to the face, limbs, or hands. These injuries often require reconstructive surgery and psychological counseling to help victims recover physically and emotionally.
It is crucial for dog owners to train and socialize their dogs, so they are comfortable around people they know and those they do not know. Most often, the victim is not to blame for the bite, but rather the blame falls on the dog owners.
Construction Site Injury
Construction workers may face injuries due to falls, heavy machinery accidents, or exposure to hazardous materials. These injuries can lead to long-term disabilities and may necessitate surgeries, physical therapy, and vocational rehabilitation to help them regain their livelihoods.
Before going to work at a construction site, it is important to make sure the site is safe and all workers are properly trained.
Wrongful death cases arise when someone’s negligence or intentional actions lead to the death of another person. Families of the deceased often suffer emotional and financial hardships, seeking compensation to cover funeral costs, lost income, and the pain and suffering of their loved one.
Nursing Home Abuse
Elderly or vulnerable individuals in nursing homes may become victims of abuse or neglect, leading to physical injuries like bedsores, malnutrition, or even fractures. These injuries can severely impact the well-being of the elderly residents, often requiring medical treatment, rehabilitation, and emotional support.
Mistreatment of our elders, in any fashion is unfathomable and unacceptable. When entrusted to care for a person who is unable to care for themselves, the nursing home must provide proper standard of care. Holding them accountable for any form of abuse or neglect, is absolutely necessary.
No one should be afraid of their caregivers, especially the young and the old. It breaks my heart and makes me incredibly angry. The nursing home does not want to deal with an angry Tim Misny!
Birth injury cases involve harm to an infant or mother during childbirth due to medical negligence or medical errors. These injuries can vary in severity, from minor injuries to life-altering conditions such as cerebral palsy or brachial plexus injuries. Birth injuries can significantly affect the child’s quality of life, leading to life-long physical disabilities and the need for ongoing medical care, rehabilitation, and specialized therapies to support their development.
Few circumstances compare to the devastation of a child who will struggle for the rest of their life because of the negligence of a medical professional. We have great healthcare in Cleveland, and to keep it great, we must ensure those whose mistakes and harmed a mother or child are held accountable.
Motorcycle Accident Injury
Motorcycle accidents can result in severe and life-threatening injuries due to the limited protection afforded to riders. Injuries may include fractures, road rash, traumatic brain injuries, and spinal cord injuries. Motorcycle accident victims often require immediate medical attention, surgeries, and extensive rehabilitation to recover.

Medical expenses include the costs of hospitalization, surgeries, doctor’s visits, prescription medications, physical therapy, and any other healthcare-related costs. These damages are essential, because they cover the treatment and care necessary for the victim to regain their health and mobility.
Damages for lost income encompass the wages or salary the injured person could not earn due to their injuries. This compensation is vital to ensure individuals and their own family do not suffer financially because they are unable to work. Damages will help to cover everyday expenses, such as rent or mortgage payments, utility bills, car payments, groceries and more.
Pain and Suffering
Pain and suffering damages account for the physical and emotional distress endured by the injured person. Mental anguish, trauma, and reduced quality of life is recognized and awarded. Monetary compensation for pain and suffering recognizes the intangible but very real toll the injuries have on the individual and his or her family.
In cases of vehicle accidents involving property damage, compensation covers the repair or replacement of the damaged vehicle and other personal property. This is important to restore the victim’s ability to commute or maintain their daily life.
Loss of Consortium
Loss of consortium are damages awarded to the injured person’s spouse or family members for the loss of companionship, support, and love due to the victim’s injuries. These damages acknowledge the strain the injuries can place on family relationships, and the need for support during the recovery process.
Future Medical Expenses
Some injuries require ongoing medical treatment, surgeries, or therapies beyond the initial recovery period. Compensation for future medical expenses ensures that the injured person can access the necessary care to improve their health and well-being for the long term.
Loss of Enjoyment of Life
This type of damage recognizes the impact the injuries have on the victim’s ability to engage in activities they once enjoyed. It compensates for the diminished ability to participate in hobbies, sports, and social activities.
If negligence or intentional wrongdoing occurred, punitive damages may be awarded to punish the responsible party so that the conduct is not repeated in the future. These damages serve as a deterrent and may help to prevent others from acting negligently.
Wrongful Death Damages
In wrongful death cases, damages are sought by surviving family members to cover funeral and burial expenses, medical bills related to the deceased’s final injury or illness. They may also include the loss of financial support, companionship, and guidance. These damages help surviving family members cope with the financial and emotional aftermath of a loved one’s untimely death.

Making Them Pay
In any personal injury case, there are two components. The first is determining liability— who is responsible, and was it negligent—meaning, did they breach the duty of care owed to another person? The second component is damages—what kind of compensation are we talking about? There may be lost wages, and even the loss of future earning capabilities. Often, medical bills and the cost of future medical care can be staggering. It is also important to consider the loss of enjoyment of life. Every situation is unique and must be considered individually.
Both liability and damages must be proven with preponderance of the evidence, and often, the market value of someone’s lost earning potential can be a very significant number. I employ nationally recognized experts to prove my cases and put a number on lost income potential. Then I’ll Make Them Pay!®.
I hire experts in accident reconstruction, vocational rehabilitation, engineering, and other types of others. My medical resources include experts in physical, internal, orthopedic, neuropsychological, prosthetics, orthotics, and psychiatric medicine.
