Personal Injury Claims 101
A personal injury can take on many forms, but no matter what form it takes, a victim’s life may be forever changed. Sustaining a personal injury, whether it was due to negligence or malice, can make it hard for you to live you life without an acute awareness of how your injury has made your day-to-day living a challenge. You may have been injured at work by a mechanical failure, or suffered harm from medical malpractice while receiving treatment for an unrelated condition. Maybe you were driving down I-71 and were rammed by a drunk driver, or you were bitten by your neighbor’s dog. Regardless of what happened, you may have a personal injury case against the responsible party who victimized you.
Personal injuries are never simple. While that in itself can be devastating, a personal injury is a malignant gift that keeps on giving. It can take a toll on your mental health, leading to depression or PTSD. After sustaining a personal injury, you may find yourself in an endless stream of doctor’s appointments, rehabilitation, and physical therapy. An injury can also prevent you from working, which puts a strain on your bank account as medical bills pile up. Interpersonal relationships may also suffer.
I’ll be the first to admit that it pains me to see an innocent person suffering from a personal injury. I hate when people are hurting, and I despise seeing a negligent party walking away without being held accountable. That’s why I have dedicated more than 40 years of my life representing victims just like
I have represented thousands of clients, in a wide array of personal injury cases. Listed below are some of the injuries that occur resulting in personal injury claims:
Medical Malpractice
Medical malpractice occurs when a doctor fails to provide quality of care that results in injury. Mistakes include:
Misdiagnosis
A patient presents with symptoms of a serious medical condition, but the healthcare provider fails to correctly diagnose the condition. As a result, the patient does not receive the appropriate treatment in a timely manner, and suffer worsening health or even death.
Surgical Error
During a surgical procedure, a surgeon makes a preventable mistake. This could be operating on the wrong body part, leaving surgical instruments inside the patient, or performing a procedure without proper consent. These errors can result in severe complications, additional surgeries, and long-term harm to the patient.
Medication Errors
Healthcare professionals administer the wrong medication, incorrect dosage, fail to consider a patient’s allergies or potential drug interactions. Medication errors can lead to adverse reactions, worsening medical conditions, and even fatalities.
Birth Injuries
Negligence during childbirth can result in birth injuries to the newborn or mother. Examples include mishandling of forceps or vacuum extractors, failing to monitor fetal distress, or delaying necessary medical interventions during labor and delivery.
Failure to Obtain Informed Consent
Healthcare providers must explain to their patients of the risks, benefits, and alternatives of a medical procedure or treatment before obtaining their informed consent. Failure to do so can result in a medical malpractice claim if the patient experiences unexpected complications or harm due to lack of information.
Automobile Accidents
This can include car, truck, and motorcycle accidents. Injuries someone may suffer from an auto accident include:
Whiplash Injury
When a rear-end collision occurs, the at-fault party fails to stop in time, causing their vehicle to collide with the back of the victim’s car. The sudden impact jerks the accident victims’ heads forward and backward, causing soft tissue damage to their neck and spine. The accident victims experienced a rapid acceleration and deceleration of their neck, which strains the muscles, tendons, and ligaments in the neck and upper back.
Broken Bones
A T-bone collision occurs at an intersection when one driver runs a red light or stop sign, and strikes the side of another vehicle. This type of accident often results in significant damage to the vehicle due to the perpendicular impact. The accident victims may suffer broken bones, such as fractured limbs, ribs, and pelvis, along with other catastrophic injuries.
Traumatic Brain Injury (TBI)
A high-speed accident, regardless if both vehicles are traveling fast, or just one, can result in horrific injuries. Sadly, personal injury attorneys like me, have to console victims’ families because their husband, wife, child, sibling or parent sustained a traumatic brain injury (TBI). A direct impact of the head against the steering wheel, dashboard, or windshield, often results in a traumatic brain injury.
Spinal Cord Injury
When a driver loses control of his/her vehicle due to inclement weather, or to avoid something in the road, a rollover accident can occur. The driver, and possibly passengers inside the rolling vehicle can sustain a spinal cord injury as a result of the violent movement of the vehicle. If the rollover occurred due to some else’s negligence, you need to call me as soon as possible!
I work on a contingency fee basis, which means, if you don’t get paid, neither will I. Knowing how to deal with insurance companies will be crucial to securing compensation to cover ongoing medical expenses, rehabilitation costs and more.
Wrongful Death
A multi-car pileup may ensue on a foggy morning when visibility is severely limited. Reduced visibility and speed can prevent a driver from stopping on time. As such, vehicle after vehicle may collide into one another. If a multi-car collision was due to someone’s negligence, they must be held accountable for any injuries. Tragically, some victims of a multi-car accident may lose their lives, which means possible wrongful death cases.
Work Related Injuries or Illnesses
These include catastrophic injuries, acute illnesses, and even injuries that appear over time. Examples of work injuries include:
Slip and Fall Injury at Construction Site
A construction worker may try to navigate a site that has uneven terrain and debris. Inadequate signage and/or safety precautions, results in a slip and fall injury. The slip and fall injury, may result in fractures, sprains, or head injuries, depending on the circumstances of the fall. These injuries may also require extensive medical treatment and therapy.
Repetitive Strain Injury in an Office Setting
Employees may be required to perform repetitive tasks such as typing on a computer for extended periods of time without ergonomic support. As a result, they can develop a repetitive strain injury, such as carpal tunnel syndrome. Due to the continuous strain on the wrists and hands, medical treatment may involve physical therapy, braces, or surgery. Repetitive work injuries often result in injury claims,

Chemical Exposure in a Factory
A factory worker can be exposed to hazardous chemicals due to inadequate safety protocols and protective equipment. If exposed to hazardous chemicals, the worker can suffer chemical burns, respiratory issues, or other adverse health conditions. Medical treatment may involve specialized care, oxygen therapy and more.
Machinery Accident in a Manufacturing Plant
A manufacturing plant employee can suffer a severe injury if a malfunction occurs while driving or using a heavy piece of machinery. Machinery malfunctions happen frequently and results in many injury victims. Workers can sustain crushed limbs, amputations, severe fractures and even death. Extensive medical treatment, including surgeries and rehabilitation, may be necessary.
Sometimes, an insurance company refuses to compensate for this type of injury claim. This is precisely why it’s very important to hire a personal injury lawyer. My team will gather evidence, hire experts, and everything I have to in order to obtain financial compensation for you!
Fall from Heights
A construction worker can fall from an elevated height because they were not outfitted with proper safety harnesses. The injuries suffered can include; broken bones, internal injuries, spinal cord injury, or head trauma. These injuries can require extensive medical treatment, surgery, and help with emotional distress.
With my decades of experience in personal injury law, I will help you recover compensation for your injury. Gathering all medical records, evidence of poor workplace conditions, and the extent of the injuries is essential when pursuing a personal injury claim.
Birth injuries
A birth injury can harm either the mother or the baby, or both, and result in cerebral palsy, uterine rupture, or death for the victims.
Brachial Plexus Injury
During childbirth, excessive pulling or improper handling by a healthcare provider may lead to a brachial plexus injury. A brachial plexus injury involves damage to the network of nerves controlling the arm and hand. This can result in weakness, loss of sensation, or even paralysis in the affected arm.
Cerebral Palsy
Oxygen deprivation to the baby’s brain during delivery, often due to a delayed C-section or a traumatic birth, can lead to cerebral palsy. Cerebral palsy is a group of neurological disorders that affect coordination and body movement. This may result in motor skill impairment, developmental delays, and in severe cases, lifelong disabilities.
Facial Nerve Injury
The use of forceps, vacuum extraction during delivery, or pressure applied to the baby’s face during a difficult birth, can cause facial nerve injuries. Facial nerve injuries can lead to facial paralysis or weakness in the baby’s facial muscles This can affect their ability to close their eyes, smile, or make other facial expressions.
Hypoxic-Ischemic Encephalopathy (HIE)
HIE occurs when the baby’s brain is deprived of oxygen and blood flow during childbirth due to factors such as a ruptured umbilical cord, placental problems, or prolonged labor. HIE can result in severe brain damage and may lead to developmental delays, cognitive impairment, and seizures, thus affecting the child’s overall quality of life.
Erb’s Palsy
Erb’s palsy is often caused by excessive pulling on the baby’s head and neck during delivery, particularly when the shoulders become stuck behind the mother’s pelvic bone (shoulder dystocia). Erb’s palsy is a brachial plexus injury specific to the upper arm, causing weakness or paralysis in the arm.
Birth injury cases can lead to significant emotional distress, medical expenses, lost income due to caring for an injured child, and lifelong challenges. Expert witnesses, such as medical professionals, may be called upon to provide testimony regarding the cause and extent of the birth injury in these cases. I work with a team of experts who will calculate how much compensation you are entitled to receive. As your personal injury attorney, I’ll Make Them Pay!®

ASK TIM A QUESTION
NO COST TO YOU!

There's the Tim Misny you see on the billboards and on TV, but there's another Tim Misny that I know up close and personal.
The Tim Misny I know is genuinely passionate about helping the hard working little folks who get pushed around the big folks. He actually, really honestly cares about people who run into bad luck at no fault of their own. Tim has quietly, out of the sight of cameras and with no fanfare shared generously with the marginalized in our society; single moms, Veterans and others without expecting anything in return.
He calls them like he sees them and you wouldn't want to take your troubles to anyone else.
Thank you Tim for being a light in this community!

Thank you Tim
father figure one day. Tim loves nature & shares the true beauty of nature with how he raises his kids. From biking through trails & having his kids learn how to nurture the family garden - he teaches valuable lessons on how to appreciate the world we live in. I know that Tim is just a phone call away & always urgent to responding no matter the situation. He has given me some of the greatest advice & continously throwing positive energy my way! I'm honored to know him & be a friend of his. He is the true practioneer of changing lives & paying it forward. He has taught me so much in just a short amount of time. Tim Misny, a man that wakes up every single day to make a difference!

After I helped him through the checkout and he left, many different employees at the garden center asked me if I knew who that man was. I did not. They told me, “That’s Tim Misny!” Once I figured out “who” Tim Misny was, my confidence grew. It was a pivotal moment. One in which steered the rest of my life. His words stuck with me. I worked hard and obtained my Associate’s Degree in Criminal Justice. I was hired by a local Law Enforcement Agency at the age of 21. I was sent to the Ohio State Highway Patrol Academy, which was an extremely tough place to be, to say the least. At the Academy, they try to break those who don’t have a determined spirit. On days I wanted to quit, I remembered Tim’s words. Maybe it was fate, maybe it was random chance.... I’ll never know But, Tim Misny helped me have the confidence and determination that was necessary to be where I’m at today. I’ve been a law enforcement officer for over 16 years. I’ve told this story to many of my coworkers.
Tim, you’ll never understand how your words that spring day helped shape my future. Your words enabled me to provide a great life for myself and my family. I’m forever grateful.
Mike
