Meal kits are a great way to try new recipes, cut down on time spent preparing meals and avoid wasting excess food—but days after Daily Harvest announced a voluntary product recall, two plaintiffs filed suit against the company.
CNN reports that the plaintiffs were sickened by the French Lentil and Leek Crumbles meal, which led to severe gastrointestinal pain, elevated liver enzymes and eventually, gallbladder removal.

Is Daily Harvest at fault?
The company recently announced that they had received nearly 500 reports of sickened customers. Between April 28 and June 17, 2022, Daily Harvest recalled about 28,000 units of lentil and leek product. So far, two plaintiffs have reported severe gallbladder and liver damage.
A product recall doesn’t necessarily mean a plaintiff will recover damages. Products liability, a type of personal injury claim, allows plaintiffs to sue a manufacturer for a defective or dangerous product. However, they need to have suffered actual harm—and be able to prove the other elements of negligence, too.

As the Food and Drug Administration conduct their own probe, Daily Harvest issued their own statement: “[W]e launched an investigation to identify the root cause, working closely with the FDA, multiple independent labs, and a group of experts that includes microbiologists, toxin and pathogen experts as well as allergists…All pathogen and toxicology results have come back negative so far.”
The results of the investigations could have a significant impact on lawsuits, especially if the outbreak’s cause is identified.
