Workers’ compensation is a type of insurance that protects employees from any illness or injury that may occur as a result of their job. For example, a production line employee in a manufacturing facility gets injured because of a machine malfunction can use workers’ compensation to pay for healthcare costs that are the result of the injury that occurred.
There are limits to who workers’ compensation policies cover. Independent contractors are not covered by workers’ compensation, even if they work full-time. In Ohio, employers are not required to purchase workers’ compensation coverage for independent contractors. As a result, when a workplace injury or illness occurs to an independent contractor, that contractor may have limited options for receiving assistance.
If you are starting a new position as an independent contractor, you should ask specifically about insurance coverage and workers’ compensation coverage. Ask questions such as:
- Will safety training be provided?
- Will you be performing work at the company’s work site? Will the company dictate how you complete the work they assign to you?
- Are the tools or materials needed for the job being provided by the company, or by you? How can you be sure that tools provided by the company are safe and in good condition?
Having an understanding of this kind of information can help you identify potentially unsafe job roles as an independent contractor. Without taking safety precautions, your job as an independent contractor becomes more dangerous and more likely to result in injury.
Some companies may misclassify roles as independent contractors when they need regular, full-time assistance in order to get out of paying for workers’ compensation coverage. There has also been a recent rise in the number of contractor positions available, marketed as “independent contractor” positions or “freelance” gigs. These positions are not required to offer workers’ compensation. The Bureau of Labor Statistics recently reported that as many as one in eight worker deaths occur to workers classified as independent contractors, who are not covered for any workers’ compensation benefits.
